Attached above are copies of the existing sections of the City Charter and City Code that pertain to municipal voting.
Attached above are copies of the proposed amendments to the City Charter and City Code introduced by the opponents of All-Resident Voting.
These bills, if passed, will:
Abolish the requirement of verifying residency status every 2 years for noncitizens who wish to vote in city elections, thereby decreasing electoral integrity and security.
Require noncitizen residents to schedule an appointment to register to vote, despite there being no such need for an appointment for citizens to register to vote. (This poses a potential 14th Amendment equal protection clause violation that could cost the city hundreds of thousands of dollars in legal fees and payouts to affected parties for negligence.)
Repeal the list of acceptable documents that reasonably demonstrate residency.
Abolish same-day voter registration, thereby decreasing and discouraging voter participation.
Require noncitizens to record their personal information in a voter registry.
This creates a security and privacy risk for noncitizens if the Department of Homeland Security (DHS) were to seize this data from the city. Under the Trump Administration, DHS and ICE have become infamously known to regularly violate the 4th and 5th Amendment rights of both natural-born citizens and immigrants.
These are the reasons why we're telling the City Council to LEAVE THE LAW ALONE!
